OFFICIAL RULES FOR THE SUN-IN "GO FOR THE GLOW" CONTEST
1. CONTEST ENTRY PERIOD: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. Contest entry begins March 4, 2008 at 12:01 AM (ET) and runs until May 5, 2008 at 11:59 PM (ET) (the "Contest entry period").
2. HOW TO ENTER: To enter the Contest, go to www.seventeen.com/gofortheglow to complete and submit the entry form pursuant to the onscreen instructions. Or mail your entry with your name, complete address, telephone number, email address, and date of birth with first-class postage affixed to: Sun-In "Go For The Glow" Contest, c/o Seventeen Promotion Department, 300 West 57th Street, 18th Floor, New York, NY 10019. Mail entry must be postmarked by May 5, 2008 and received by May 9, 2008. Send in your photo with a 100-word essay describing why you like using Sun-In, and what you're doing to improve your community.
3. WINNER SELECTION: Representatives of Seventeen and Sun-In will judge all Contest entries based on the quality, clarity of expression and originality of brief essay, telling us why you like using Sun-In, and what you're doing to improve your community (75%); and submitted photo (25%). Five (5) finalists will be chosen from all eligible entries and notified by telephone or e-mail the week ending May 10, 2008. To determine the grand-prize winner, all five (5) finalists' entries will be posted online at www.seventeen.com/gofortheglow where users will vote for their favorite finalist starting the week ending May 17, 2008. Online voting ends June 8, 2008. The finalist who receives the most online votes will win the grand prize. In the event of a tie, the person among the tied entrants with the highest score on the essay, as determined by the judges, will be the grand-prize winner. The grand-prize winner will be notified on June 9, 2008. Winner must be able to travel and appear in a photo shoot any time from June 9, 2008 through June 15, 2008. By participating in the Contest, entrant certifies that her entry is original, has not been previously published or won any award, and does not contain any material that would violate or infringe upon the rights of any third party, including copyrights, trademarks or rights or privacy or publicity. Sponsors reserve the right in their sole and unfettered discretion to disqualify any entry that they believe contains obscene, offensive or inappropriate content, that does not comply with these official rules or that is not consistent with the spirit or theme of the Contest. The decisions of the Sponsors and judges are final and binding on all matters relating to the Contest.
4. PRIZE AND APPROXIMATE RETAIL VALUE ("ARV"): Grand Prize: One (1) winner will receive a three (3) night trip to a sunny destination determined by Seventeen where she will star in a custom photo shoot for the Sun-In "Go For The Glow" ad in Seventeen and other Sun-In ad creative. Trip includes round-trip coach air transportation for two (2) people from major airport nearest winner's residence and hotel accommodations for two (2) people for three (3) nights. Air travel and hotel accommodations at Sponsors' discretion, accommodations and travel subject to availability and blackout dates may apply. All travelers must possess valid travel documents (e.g. valid photo ID). All other expenses not specifically stated in the prize description will be the sole responsibility of the winner. ARV of prize package is estimated to be $3,500. In the event the winner is a minor, then Parent or Legal Guardian must accompany the winner. Winner must be available to travel and appear in a photo shoot any time from June 9, 2008 through June 15, 2008 on dates determined by Seventeen, otherwise, the prize will be forfeited and the finalist with the second highest number of votes will become the Grand Prize winner. Winner will be notified via phone, e-mail or U.S. postal mail, at Sponsors' discretion, on June 9, 2008. Winner is solely responsible for any and all applicable fees, local, state and federal taxes, including income taxes. Grand Prize winner will receive a 1099 on the actual value of the prize. Other Finalist Prizes: The other remaining finalists, if eligible will receive a year's supply of Sun-In products selected by Sponsors. Approximate retail value of remaining finalists' prizes is $100 (Total ARV for all four prizes: $400). The prize of any such finalist who is ineligible will be awarded to an eligible entrant selected in a random drawing. Total ARV for all prizes awarded: $3,900.
5. ENTRY LIMITATIONS: Limit (1) one entry per person regardless of method of entry for "Go For The Glow" "Contest". Entries using macro, robotic, script or other forms of automatic entry will be disqualified. Entries become the property of the Sponsors and will not be returned. Illegible, incomplete, mutilated, postage due or mechanically reproduced entry forms or entry forms that have been tampered with will be disqualified. Proof of submission does not constitute proof of receipt. Sponsors are not responsible for lost, late, mutilated, misdirected, incomplete, illegible, inaccurate or postage due entries. If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the email address, if otherwise eligible. The "authorized account holder" is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
6. ELIGIBILITY: Contest open to legal female residents of the 50 United States and the District of Columbia who use Sun-In and are 13-24 years of age at the time of entry. Contest is void in Puerto Rico and where prohibited by law. Employees of Sponsors, their Sponsors' parents, affiliates and subsidiaries, participating advertising and promotion agencies, the prize suppliers (and members of their immediate family and/or those living in the same of household of each such employee) are not eligible.
7. CONDITIONS OF PARTICIPATION: Online entrants must have valid e-mail address and it is entrant's responsibility to update Sponsor Seventeen at the above Seventeen mailing address of any change in e-mail address. All taxes are the sole responsibility of the winner. Each prize is awarded "as is" with no warranty or guarantee, either express or implied, outside of prize suppliers' limited warranty or restrictions and conditions. No transfer, assignment or substitution of a prize permitted, except Sponsors reserve the right to substitute a prize for item(s) of equal or greater value in the event an advertised prize is unavailable. All federal, state and local laws and regulations apply. By participating in this Contest, entrants agree to be fully and unconditionally bound by the terms of these Official Rules and by the decisions of Sponsors and judges, which are final and binding on all matters pertaining to this Contest. Sponsors' failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Winners (and parent or legal guardian if winner is a minor) will be required to sign and return an Affidavit of Eligibility, a Liability Release and, where legally permissible, a Publicity Release, within seven (7) days following the date of first attempted notification. Failure to comply with this deadline may result in forfeiture of the prize and selection of an alternate winner. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Travel companion of winner must also execute a Publicity/Liability Release prior to ticketing and must possess required valid travel documents (e.g. valid photo I.D.) prior to departure. Once the travel schedule has been arranged, it cannot be altered and failure of winner to follow such schedule shall not obligate Sponsors in any way to provide the winner with alternate arrangements. Winner hereby further agrees that she will sign any documents necessary to transfer copyright of the entry to Sponsors within seven (7) days following the date of first attempted notification. Acceptance of the prize constitutes permission for Sponsors and its agencies to use winner's name and/or likeness, biographical material and/or entry (including an altered form of the entry) for advertising and promotional purposes without additional compensation, unless prohibited by law. By accepting the prize, winner agrees to release and hold Sponsors, its advertising and promotion agencies and their respective parent companies, subsidiaries, affiliates, partners, representative agents, successors, assigns, officers, directors, and employees harmless for any injury or damage caused or claimed to be caused by participation in the Contest or acceptance or use of the prize. Sponsors are not responsible for any printing, typographical, mechanical or other error in the printing of the offer, administration of the Contest, or any mailing or postal error in entry or notification, or in the announcement of the prize. In the event of any such error which Sponsors, in their sole discretion, determine interferes with the proper or intended administration of the Contest, Sponsors reserve the right to cancel, modify or suspend the Contest.
8. INTERNET: Sponsors are not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsors or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If, for any reason, the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest. Sponsors reserve the right to select winners and/or finalists from eligible entries received as of the termination date. Sponsors further reserve the right to disqualify any individual who tampers with the entry process. Sponsors may prohibit an entrant from participating in a Contest if it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices or by any actions intending to abuse, threaten or harass other entrants. Caution: Any attempt by a participant to deliberately damage any Website or undermine the legitimate operation of the Contest is a violation of criminal and civil laws and should such an attempt be made, Sponsors reserve the right to seek damages from any such participant to the fullest extent of the law.
9. DISPUTES/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in New York, NY (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. New York State law, without reference to New York's choice of law rules, governs the Contest and all aspects related thereto. If any of the provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in force, unless, in the sole discretion of the Sponsors, such invalidity or unenforceability defeats or undermines the purpose of the Contest, in which case Sponsors reserve the right to cancel, modify or suspend the Contest.
10. PRIVACY POLICY: Hearst Communications, Inc. strictly adheres to COPPA guidelines and never shares user information with third parties unless the user opts in to receive information. As a standard, all Seventeen.com pages, including custom pages, link to the privacy policy. The entire privacy policy is available at seventeen.com/privacy.
11. WINNER'S LIST: For winner's name, send a separate self-addressed, stamped envelope to Seventeen, Sun-In "Go For The Glow" Contest, Promotion Department, 300 West 57th Street, 18th Floor, New York, NY 10019 by June 30, 2008.
