One entry per person per Cosmo’s Free Stuff. Employees (and their immediate families) of Hearst Communications, Inc. ("Sponsor") and its subsidiaries and affiliates are not eligible. Winners may be asked to submit an affidavit of eligibility/publicity release. By accepting a prize, except where prohibited by law, winner grants Sponsor the right to use her name and likeness for advertising and promotional purposes without notice or further compensation. Participation constitutes entrant's full and unconditional agreement to and acceptance of these rules. If any winner cannot be contacted for any reason within ten (10) business days from the date such winner is announced; is ineligible; fails to claim her prize; or, where required or requested by Sponsor to do so, fails to return the completed and executed affidavit of eligibility/publicity release within fourteen (14) days of prize notification; her prize may be forfeited and an alternate winner selected at random. By entering the sweepstakes, entrants release and hold harmless Sponsors, and their respective parents, affiliates, subsidiaries, agents, advisers, employees, officers, directors, shareholders, and representatives from any and all losses, damages, rights, claims, and actions of any kind arising in connection with the sweepstakes or resulting from acceptance, possession, or use or misuse of any prize, including without limitation personal injury, death, and property damage, as well as claims based on violation of publicity rights, defamation, or invasion of privacy.

Sponsor is not responsible for incomplete entries, computer system, phone line, hardware, software, or program malfunctions, or other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature. Entrants must have valid e-mail address, and it is their responsibility to keep their e-mail addresses current with cosmopolitan.com. Sponsor reserves right, at its sole discretion, to cancel or suspend sweepstakes should virus, bugs, or other causes beyond control of Sponsor corrupt administration, security, or proper play of the sweepstakes. In the event of a dispute regarding the identity of a person submitting an electronic entry, the entry will be deemed to be submitted by the person in whose name the e-mail account is registered. Any attempt to deliberately damage any Web site or undermine legitimate operation of sweepstakes is a violation of criminal and civil laws, and Sponsor reserves right to seek damages from any violator to fullest extent permitted by law. Winners will be chosen by random drawing, and odds of winning are based on the number of eligible entries received for Cosmo’s Free Stuff. Drawing will be conducted by Cosmopolitan magazine. Winners are responsible for any taxes on prize. Sweepstakes open to legal residents of the United States, and the District of Columbia, age 18 and older. Residents of Puerto Rico are not eligible to enter. Prizes not transferable or redeemable for cash. Sponsor reserves the right to substitute prizes of equal or greater value at its sole discretion. Redemption instructions will accompany certificate. Liability is limited to the cash value of the package. Trip only to be used for this promotion. Certificate will be mailed directly to Cosmopolitan for distribution to winner. Prize package is valid for 12 months from award date; blackout dates may apply.
Two round-trip JetBlue travel certificates each valid for one passenger to fly round-trip from any JetBlue destination to San Juan, Puerto Rico. Travel is valid for one year from issue date of travel certificates. All travel must be booked and flown within the valid dates listed on the travel certificates. Redeemed travel is subject to availability and seats may not be available on all flights. Certain blackout dates may apply and travel may be capacity controlled. Passengers are subject and entitled to all provisions of JetBlue's Contract of Carriage, except denied boarding compensation. Redeemed travel is not eligible for TrueBlue points. 3. How to enter: How to enter: Log onto www.cosmopolitan.com/giveaways. Complete and submit the entry form for any of the Cosmo’s Free Stuff sweepstakes. For the Win a Warm Getaway! Sweeps, one winner will be chosen to win: Three nights for two people in a suite at the Sheraton Old San Juan Hotel, daily breakfast for two, two-hour usage of electric car to explore the historic district, spat treatment for two at the Eden Spa (total retail value $1,350), and roundtrip airfare for two, courtesy of JetBlue Airways. Sweepstakes begins August 14, 2007. Entries must be received by 11:59 p.m. ET, September 10, 2007. Ability to enter to win may be closed during specific times, per Cosmopolitan’s discretion. DISPUTES/CHOICE OF LAW: Except where prohibited, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by state or federal courts situated in New York, NY, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (3) no punitive, incidental, special, consequential or other damages, including without limitation lost profits may be awarded (collectively, "Special Damages"), and (4) entrant hereby waives all rights to claim Special Damages and all rights to have such damages multiplied or increased. New York law, without reference to New York’s choice of law rules, governs the Sweepstakes and all aspects related thereto.

INTERNET: Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any Web site or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion. Sponsor reserves the right to select winners from eligible entries received as of the termination date. Sponsor further reserves the right to disqualify any individual who tampers with the entry process.
